Hearts’ Privacy Policy (hereinafter “the Policy”) details how the Hearts application (hereinafter “the App”) and Hearts Dating Inc. (hereinafter “we”, “us”, or “the Corporation”) collects, stores, utilizes, and shares data uploaded by users including yourself (hereinafter “User Data”).
1. Data Collection, Storage and Usage
While using the App, you are providing us your User Data which includes but is not limited to your name, contact Information, demographic information, biometric information, banking information, location, pictures, videos, and other Personal Identifiable Information (PII).
We will check for data that breaches our Terms and Conditions of Use. If certain data is found to have breached the Terms, then the user may be blocked from using the App and the User Data will be retained for further investigation and possible referral to relevant law enforcement authorities.
If you utilize the paid features of the App, we will process your payment data and retain it for audit and tax purposes.
If you give the App access to your location using your device settings, the App may collect data on your latitude and longitude, and we may save your device’s location history.
The App may collect data about your device including the unique device identifier, device model, and operating system.
The App may collect data from your device automatically by using cookies or similar technologies.
The App may access your device’s address book.
The App may keep track of how you interact with links available on the App including third party services by redirecting clicks or through other means. We may share with third parties, your aggregate clicks statistics.
We may request from you feedback, testimonials or ask you take part in marketing campaigns on an optional basis. Any data you provide for these purposes will be considered as User Data.
The App is global, and User Data will be sent to and stored in the United States and India regardless of the country you reside in.
We may permanently store User Data.
We will not sell your data.
2. Data Disclosure
We may disclose User Data to certain third parties for specific purposes. These include but are not limited to:
i. Software providers to perform certain software and data functions to facilitate usage and development of the app.
ii. Authentication service providers to facilitate creation of user profiles on the App.
iii. Financial payment process providers to facilitate payments on the App.
iv. Anti-spam and Anti-fraud data investigation services to filter out fake users, bot profiles and other damaging and prohibited content from the App.
v. Marketing service and social media providers to grow the App user base.
vi. Demographic profiling service and industry analysis providers for market research purposes.
3. Data Security
The App implements security measures to safeguard the confidentiality of User Data. But we cannot provide 100% guarantee against unauthorized access, hacking, data loss or other breaches. Make sure to log out of the App after use, do not share your profile password with anyone and change your password periodically. We cannot guarantee the security of User Data data while it is being transmitted to and from the App and between its third-party service providers. All data transmission is at your own risk.
4. Data Rights
Privacy laws applicable in your country may give you some rights over your data. If you want to exercise any of your data rights, please contact us. Below are some of the rights that you may have in relation to your User Data.
i. Right to be informed about how we are utilizing your User Data.
ii. Right to access a copy of your User Data.
iii. Right to rectification if your User Data being held is inaccurate.
iv. Right to erase/delete your User Data under certain circumstances.
v. Right to restrict, stop or object to processing of your User Data under certain circumstances.
vi. Right to have human intervention is certain automated decision-making processes.
5. Data Retention and Deletion
We retain User Data only if we need to and as permitted by applicable law. When you delete your Account, it will no longer be visible on the App. We may retain your User Data in case you would like to restore your Account, to complete the processing of payments due, for tax and accounting purposes or for other legal purposes as required by applicable law. The data will be retained only for legitimate business purposes.
6. Changes
We may modify, amend, or change the Policy at any time (hereinafter “a Change”). We may send an email notifying you of a Change and we may ask you to agree to a Change for continued use of the App. Your continued use of the App following any Change constitutes your acceptance of the Change and you will be legally bound by the new updated Policy. If you do not accept any Changes to the Policy, you should stop using the App immediately.
